    Employer asking about the extra paydays.

    Our withholding order says "$1,240.00 a month". Since I get paid every other week, naturally we have 2 months of the year that we collect 3 checks instead of 2. My employer has asked if he should withhold from that "3rd check" or not. Any input from others paid the same way?
    I don't want any payment to appear late, but I also don't want to pay more to the credit bastards that I have to.

    I get paid every two weeks and money comes out of every paycheck for bk payment.

      Usually the employer withholds $620.00 twice a month; maybe the better idea would be to withhold 1/3 each payday on the 3 payday months, instead withholding 1/2 out of two and giving me all the third????

        The amount of witholding takes into account the "extra" pays. Your payment plan is based on 26 pays per year. Don't let you employer adjust it.

          Ok, thanks. I probably should have known that, as why would they allow me to have any extra. Darn. Just hoping I guess. Thanks for input.

            Depends on what is withheld & how its paid.

            If you have 1/2 of a month's payment withheld per check - then no you should not owe 'extra'. But if you have 1/26th of a year's payment withheld per check - then yes deduct as usual.

            Is your plan confirmed @ $1,240 per month? If so, you should be able to work with your atty to have the wage order adjusted to be ($1,240 x 12) / 26 = $572.31 deducted per paycheck based on 26 pay periods per year.

            Or is your plan $620 per pay period, paid bi-weekly, so $620 x 26 = $16,120/yr or $1343.33 a month?
            Get mortgage modified: DONE! 7 months of back interest payments amortized, payment reduced over $200/mo
            (In the 'planning' stage, to file ch. 13 if/when we have to.)

              The confirmation order says Payment Amount: $1,240 per month
              Period of Payments: 60 months
              Total Payments: $74,400.00 or such other amount required to pay all allowed claims in full.
              So, in a normal 2 payday month, $620.00 is withheld from each check, for a total of $1,240.00 a month.
              Is that of any help in advising?

                If you're paid every 2 weeks then you should have had the wage order set up as $1240 x 12 / 26 per pay check. Afterall, your income/expenses for the plan were based on average monthly pay and not your pay for 4 weeks at a time.

                Since it was not done that way - you should be fine to leave it at deducting $1,240 per calendar month. But it would not hurt to call your atty and ask...

                  My wage order looks like this:

                  Deduction:$2,000.00 MONTHLY
                  Weekly: $461.54
                  Bi-Weekly: $923.08
                  Semi-Monthly: $1,000.00

                  They were given all the options!
                  19% dividend

                    Okie doke. Here is attorney's answer:

                    Confirmation Order is for $1,240.00 a month.
                    $1,240.00 x 12 is $14,880.00 a year divided by 26 paydays would be $572.31 a pay day.
                    But, the actual deduction was not set up that way at work. I merely requested $620 deduction from each check. I never thought about the multiplying, dividing, etc.
                    Per Attorney I can have deductions made on the extra paydays per year and maybe finish up a couple of months early, or keep the extra checks.
                    Not knowing what could happen down the road, while things are still okay for now, I will opt to go ahead and deduct from the extra pay and maybe stay ahead.
