    Chapter 13 Wage Garnishment

I was wondering if you always have to have your wage garnished? Can you pay the trustee directly yourself? I don't want my wage garnished in my chapter 13 because I am afraid somehow my employer will use this against me.

Every district is different. Some want it payroll deducted and others allow money order/certified checks to be sent. If you have a lawyer contact he/she or the trustee's office in your district.

You will have to ask your attorney what your local trustee allows.

My trustee doesn't care... Payroll deduction, ACH debit, cashiers check, money order, personal check. Pretty much any way you can send money except for credit card!

I dont have to worry about making my mortgage pmt, helco or car pmt the trustee is doing it..... I just have to pay my utilities, phone, taxes ,food ect. It is working out great at this point.

If I had all my secured payments in my plan like you I couldn't have payroll deduction... there wouldn't be enough to deduct to make the payment!

I am in Houston, TX and my trustee almost requires payroll deduction. I can say that your employer is really not allowed to use this against you. When I told my mom that I was filing and how worried I was about the payroll people knowing about it, she assured me that most have had their fair share of experience with bankruptcy these days... and if they haven't they've at least thought about it.

I'm self-employed - just take a draw. Since I'm the one filing, and my wife is NOT - they couldn't garnish HER wages, could they?

No. They can also not order you to seize your own money (since you are self employeed). You would pay directly as there is no other option.
