    Couple of questions?

    Indiana filer here...And here are my questions.

    1 - We were told at our 341 meeting that our tax checks starting with the 2010 refund would be turned over to our trustee, we are able to keep the first $1800.00, and any funds over that would go to her. Now my question is what about the state refund check? Nothing was ever said about this one.

    2 - I've been reading alot of posts on here about people receiving their paperwork breaking down who is to be paid, how much trustee gets from tax refund, etc? after their confirmation's for their Chapter 13. Ours was confirmed in October of 2009, and the only thing i have ever received is a letter stating so, and one entry for what $ would go toward my attorney. I guess my question is, are we missing something here? Or is this all you get?

    You need to ask your lawyer what the custom is in your local court. In ours (not Indiana), our trustee adds up all tax refunds (national, state, and local) and then takes whatever is over $2,000. Obviously we have adjusted our withholdings to ensure that so far at least, we've given $0 to our trustee since filing 3 years ago

    The notices and other documents you receive from your trustee are not consistent across the country. You need to ask your lawyer what your trustee normally provides to his or her filers.
