Date filed: 10/13/2005 Date of last filing: 02/27/2006 Date discharged: 02/03/2006
My friend filed chapter 7 on the above dates. He is now getting sued for unpaid credit cards, and a truck that was repod since the chapter 7 filing. He is about as judgement proof as one could get (I assume). He has no property, no bank accounts and works for cash at about 10K per year which is documented via a 1099.
Question is this...
would chapter 13 be a option for him to stop the judgements and to begin a repayment plan with the debts he has incurred since the previous filing? He has about 10K in unsecured debt. He has a child support obligation of 100.00 per week. He also has unpaid taxes from year 2007 which is not included in the 10K unsecured debt figure.
Since his income is so low, would this even be a option?
Any ideas would be helpful. He realizes he got himself into a bad situation, but is there a way out?
