    Debtors Exam

    I am filing personal bankruptcy but AMEX had obtained a default judgement on my corporation which is no longer conducting any business. Does the creditor ALWAYS do a debtors exam after the default judgement is entered? Does anybody have any experience with this?

    Corporation? If it's a true corporation then you shouldn't be personally liable? Did you sign a PG?

      No, not always.

      However, if this was your corporation there is a 100% chance that you have personally gauranteed the debt. But your BK will take care of it, just include them as a creditor. However, AMEX could still request a judgement debtor's exam for the corporation.

        Well, they sued me personally also which is why I am including it in the bankruptcy. When applying for my card I used my SS# so I assume it is is personally guaranteed. I am planning on moving out of the country which is why I am concerned about the debtors exam for the corporation. I would hate to have to fly back just for that seeing that the corporation is no longer functioning. I wonder if I can just retire from the corporation. HHM, do you have any idea how AMEX would decide if they want to do a debtors exam? The debt is over 40K.
