My wife and I went had our 341 meeting yesterday and it went off smoothly..My only question is that why didn't the trustee ask for my tax refund? She asked if we filed taxes for this year and we did say yes..Not sure if I should call the trustee..Has anyone ever experienced this before? My lawyer told me to just keep it but try not to spend it just in case they do ask for it later on..My case can't be dismissed from holding onto my refund right?

First, listen to your attorney since your Plan is not yet confirmed. Secondly, if you call the Trustee, the trustee's office will tell you to call your attorney since you are represented by legal counsel._________________________________________

Your case will not be dismissed over this. Deposit your check into your savings account and wait and see what happens. I was able to keep my tax return which was fortunate as I had an unexpected trip to the vet that ate a good portion of it.
I don't think that the trustee misses things like tax returns or pay bonuses. They have been doing this job for a while and they will let you know what they intend on taking when you get your plan. Good luck!

Trustee also asked if we had filed our 2008 return at our 341 mtg (we had a refund on our federal, but owed a very small balance on state taxes). She just asked if we had paid the balance due on our state taxes, and that was that. She never asked for the federal refund. I'm not sure if it depends on the amount of your return or not, but she never mentioned anything else about it. Hope this helps, and good luck!!!Filed Ch. 13 Pro Se 1/8/09
