My b.k update! WTH?

paid attorney on 2/16/09 to file for chap 13
b.k file date- 4/16/09
341 meeting scheduled for 5/7/09
today(4/29/09) recieved letter from trustee stating notice to dismiss case becuse:
1.failure to file standard 13 form plan schedules a-j

What the Hell? I left a message for my attorney, I have still yet to see or hear of what my proposed plan will include? So the notice from trustess says I now have a court day for 5/13/09 to apear for notice to dismiss. So does this mean I no longer go the the scheduled 341 meeting the week before on 5/7/09?

Any ideas or has anyone else delt with this before? I am worried this will look bad to the trustee and make things harder to proceed, Is that true? My attoney needs to get his S%*T together quick!!

Did your attorney file an emergency BK?

Have you checked Pacer to see what was filed?

I would go to Pacer right now and download your file and get with the attorney first thing tomorrow.

I agree with "startingover", go to pacer and check out your case. Your attorney probably filed an "emergency BK" and had 15 days (I think it's 15 days) to file the rest of the paperwork and he probably didn't follow up with it, so now your case is going to be dismissed. Forget the phone calls to your attorney, I would show up bright and early tomorrow and sit in the lobby!

I AGREE 100%. You're attorney should be handling this, that's what you're paying him for, and you need to speak with him IN PERSON, ASAP. Don't just wait to see what your attorney is going to do, MAKE him do what he's paid to do. Good luck!
