    UPDATE: CH 7 saga, UST and CH 13 conversion

    Just a quick update. As some of you have read in my past threads we went to battle with our UST after our CH 7 filing. They picked apart everything we did, asked for some records back for 3 years and questioned nearly everything we submitted. Though we had paper to back up everything they were threatening to file for a dismissal and we weren't sure what to do. Our schedules showed $199/mth available to pay back (long story, this include OT wages which we no longer make) and I wanted to fight it, along with attorney.

    However, DH was even more upset by the process than I was and we ended up having to settle on a conversion to a CH 13. The whole legal process took a toll on my DH physically (he would throw up for days on end) and mentally (he was admitted to an in-patient facility where he stayed for nearly 2 weeks for some mental health issues). He had never had any issues with his mental health at all but the fact of the matter is, when someone is looking at everythingyou've done for the past 3 years, it is a bit unnerving. We had nothing to hide, but they were even picking apart where we shopped for dog food and how much we spent on haircuts in one year. (we go to the cheap place in WalMart every 5 weeks!). Not trying to give TMI, but for some people this really takes an immense toll on them. Thankfully my DH is doing ok, on some meds and things are looking better for him every day.

    We filed our taxes & were shocked that we are getting back over $8K federal and $2K state. We've made a deal that we'll keep $2500 of the tax returns and turn the remainder over along with making our payments of $199 month for the 5 years. While it wasn't what we originally thought would happen, we are ok with the fact that we'll end up paying back about 20% of our debt (after the administrative fees) and that things are finally nearly settled.

    Anyway, just wanted to give an update to those that wondered how our UST saga ended.
    11/18/08 filed CH 7; 341: 12/11/09, cont'd to 01/06/09
    03/21/09 341 hearing for CH 13
    04/27/09 Confirmation hearing for CH 13
    $199/mth for 60 months + $9K 2008 income tax refund

    Welovedis, what a story! I'm happy that you are back on track and hopefully this bump will be just that.
