This waiting period is confusing. If someone is living paycheck to paycheck, and using cc's to get along (robbing Peter to pay Paul) , paying for food, daily living, etc. They don't have the luxury of putting everything on hold for 90 days. Are we the only ones who finally just figured out one day, that things weren't working out? Do people just not pay the cc's AND not use their cc's for this 90 day period. It would seem that by not paying you're sending a flag as well. The lawyer we talked to was only concerned with luxury items purchased recently. I told him we bought a rug for $300 about 60 days ago. He laughed and said that wasn't a luxury item.

All of us had to go through the stage of not charging. It is at that point crystal clear we are charging our living expenses - which is what brings us to this forum.
Most of us had to stop paying prior to filing BK in order to save up money for the attorney's fees.
So, you stop charging immediatly. Wait 90 days to file. Pay if you have the funds to pay each of the unsecured - if you do not have the funds - only pay your necessities like rent, utilities, food, child care etc.Filed CH 7 9/30/2008
Discharged Jan 5, 2009! Closed Jan 18, 2009
I am not an attorney. None of my advice is legal advice in any way..
