    saving for listed expenses during chapter 13

    Hello,

    I've filed for a chapter 13. I'm waiting for my 341 hearing. My question is about the listed expenses such as car and home maintenance, and other periodic expenses. If I save them in my bank account, will that be a problem? To save, it would total hundreds of dollars a month in order to be prepared for things like a new appliance, roof, dental, Christmas and birthday gifts, etc. I also plan to reduce expenses in order to be better prepared for emergencies. I'm just wondering how this would be interpreted by the trustee. I am on a minimum pay 13, (A term my attorney used) so my payments aren't high, but in going over my budget and looking at the allowed expenses, I'm wondering how I should handle this. A shoebox method seems insecure and if asked, I would have to disclose it anyway. Does anyone have any experience or advice?

    It will not be a problem. I have never heard of a Chapter 13 Trustee checking bank account balances after filing. Even at the filing, they don't need much. A Chapter 13 is much different than a Chapter 7. In a Chapter 13, the only thing the Trustee wants is your disposable monthly income (DMI) as calculated by the Means Test or agreed to in your Plan of Reorganization (Plan). It is expected that the debtor will have checking, savings, and even a 401(k) as part of their reorganization. A shoebox would be a terrible idea.
