Bad news...HELP!!!!

    So, my attorney emailed me with his plan to resolve this. I really hopes it works. I thought just amending the claims and payback % on those claims due to failure to update previously would work, but I'm not an attorney. Here was his note:

    "I am scheduling a motion to "modify the plan". The modification, or amendment, will seek to strike the language with regard to the percentage. This would then create a situation where Section D controls, meaning the total amount to be paid."

    The hearing will be next month on the 12th. He says I don't have to attend, but I think the judge may take pity on a pregnant woman if I go!!
    Filed Chapter 13 with lien strip on 2-28-11 * 341 held on 3-30-11 * First confirmation hearing held 4-20-11, continued until 5-25-11, continued until 6-29-11, continued until 8-10-11. Plan finally confirmed on 8-10-11!!!

      Don't waste your time going to the hearing. The judge will make a decision based on the law. The modification make sense. It is the plan payment that was based on our dmi and the fact that you have completed a 60 month plan that should matter, not the percentage paid.

      I'm sorry you have deal with this stress and hope all goes well!
