    341 today...so frustrated!

    I'm new here and have enjoyed reading all of your informative posts about 341 meetings. I am a Chapter 7 pro se filer. I had my 341 this morning and, like most people, I was anxious but ready to get it over with and be done....well....wrong! The trustee was so hung up on why my husband didn't file with me. (We've only been married since 2007 and all the debt I filed on was my debt incurred before we got married). And, then he criticized me for having such a large amount of debt, and questioned "how did you rack up this much credit card debt". If he examined my schedules, he would see that it wasn't all credit card debt. There was some medical expenses and other expenses I listed. He wants my recently received tax refund (which I still have the check because I was afraid to do anything with it yet), which is around $3,000. My debt totals around $100,000 so the tax refund isn't even going to put a dent in it. So, I either have to turn the tax refund over to him, or I can amend and exempt out what I can of it. Ugh! He continued my meeting and I have to produce copies of bank statements, car title, personal property tax statement. Bottom line for me....he seemed real hung up on the things I didn't think were big issues and he didn't even address the things I thought were going to be an issue. Go figure! I am just real frustrated that I still have to go before him AGAIN. I SO wanted this over and done....

    Thats normal for a 341 hearing, actually it should have been given to the trustee prior to the 341 or at least brought with you to it - as well as the tax return and wanting it. I'm sorry you are so stressed out, but rest assured, its all normal for the 341 hearing. Amend your papers and see if you can exempt your return, but you may not be able to if the trustee already wants it and your 341 is already done, unless there is a continuation of it. Others that have been in your situation I'm sure will chime in on how they proceeded with this scenario.

    Good luck to you and dont stress too much, it is what it is at this point.

      Provide the Trustee what they want and hopefully you'll be one step closer to a Discharge. Though the 341 goes "easy" for some that isn't always the case (alot of it depending on the Trustee, the paperwork, etc.) Remember, the Trustee's job is to focus on two questions: Do you qualify for a Chapter 7 and if so, are there any assets worth liquidating. Hang in there. Amend the Petition to Exempt (hopefully you can depending on what else you've exempted and your state) and provide ALL the docs asked.
