    Student loans in Indiana Ch 13

    Okay I did try to read 3 pages of posts here before asking this; so I am sorry if it has been addressed in the past. Does anyone know how Indiana handles student loans? Can they be paid during chapter 13? I have read that most states push them aside for 5 years & allow them to acrue interest (yuck) but I am hoping Indiana is not one of those.

    I'm in Chapter 13 and I live in Indiana. I was told by my attorney that I could INCLUDE my student loans into my plan. That's what I did, as I have $30k in student loan debt. My student loans will be paid when my unsecured debt is paid. I'm 100%, so my secured will be paid in about 2 years, and the unsecured will start after that. I can't believe I will be debt free in less than four years!!!

      This really isn't a state by state issue. k2k04's scenario is typical. If you are in a 100% plan (meaning, you are paying your unsecured creditors 100% of their claim), then you can include student loans. Otherwise, you cannot.

      Depending on the amount of your student loans, your attorney can pad your budget in places to give you at least enough to make interest only payments during the life of your chapter 13 plan.

        I don't know if it is the same state-wide, or just in my particular case.

        My student loans were not permitted to be included in my chapter 13 plan. I was told that we could make payments outside of our plan, and I would like to have been able to make at last some payments since my balance is large (about $20k at time of filing) and interest will accrue. However, I have found that I really can't afford to do so, and I don't have a clue where to send payments if I could. My loan has been transferred to someone else--I don't even know who.

        My biggest concern now is how much my payment will be once my 13 is discharged, and if it will be considered "current" when I resume payments. It was several payments behind when we filed. I would hate to have my "fresh start" and my SL loan to resume with 120 days past due.
