I'm hoping someone has some advice for me. Yesterday, on my way out of town for work, I stopped at the post office and picked up my mail. I saw a handwritten envelope from my employer, which was odd. I ripped it open and found a letter of garnishment inside. I reveiwed the document and came to find out that the creditor was one that was included in my discharged bankruptcy two years ago. I called my payroll department and told them about the situation. They said that they could not release the garnishment without a letter of release from the creditor.
I then called the creditor, who informed me that the original company went bankrupt and must not have forwarded the bankruptcy information with the file. He said that I needed to fax him the discharge paperwork (which I didn't have since I was out of town for work) and that he would MAIL it to my company to release. He said that if they ended up getting a check erroneously, that they would send it back. This just didn't seem right to me. How can they just TAKE money from my check erroneously???????? and then keep it for a matter of time before returning it?? It just doesn't seem right! What a nice xmas gift huh??? I guess I'll have to tell my kids... sorry... no xmas dinner because we got ripped off by the system right before the holidays.
