I filed bk in Aug 25, 2008 and signed a reaffirmation agreement with Citi (2nd mortgage holder) on Nov 24, 2008 but never had a hearing and the court states there is no reaffirmation agreement filed with the court.

Indymac holds 1st position on my home and sent me a modification agreement on Aug 27, 2008. I was told verbally on two separate occasions by Indymac loss mitigation (Oct 27, 2008 and Nov 11, 2008) that the modification agreement with Indymac was approved. However, when I received the reaffirmation agreement from Indymac it did reflect the new modified mortgage payment. I'm now being told that the modification is not valid and I need to sign the reaffirmation agreement and then I might be considered for modification or a repayment plan.

Is the Citi reaffimation valid? Should I sign the Indymac reaffirmation agreement?
