    questions asked at my 341

    OK, so after my lawyer found out which trustee i was going to have, he gave me a "cheat sheet" of what would be asked. ( he said every trustee asks diff questions, that's why he had to wait to see who i was going to have) but i bet you they are similar to what other trustees may ask at a chapter 7 BK. All i want to say is the trustee asked these same questions to everyone i watched before me and nothing more. 1st the trustee will call you up and swear you in.

    You have filed a BK petition under the chp 7 BK code, will you please state your full name and address for the record?

    Did you sign the petition, schedules, statements, and related documents you filed with the court?

    Did you read them before you signed them?

    Are you personally familiar with the information contained in them?

    To the best of your knowledge, is this information true and correct?

    Are there any errors or omissions to bring to my or the courts attention at this time?

    Are all of your assets identified in the schedules?

    Have you listed all your creditors in the schedules?

    Have you ever filed BK before? if so when?

    What is the address of your current employer?

    Is this tax return that you supplied and that i am now handing back to you a true copy of the most recent tax returns you filed?

    Do you have any domestic support obligations?

    Have you read the BK information sheet provided by the US trustee?

    Are there and creditors present who wish to question the debtor? (none)

    HAVE A NICE DAY!

    and that was it!
    retained lawyer june 08, filed may 09....341 on 6/26/09- went smooth! Glad to be part of the 60 day club .... AND- 6/27/09- got engaged
    10/30/10- WEDDING!!
    09/04/09-discharged!!!

    All of your questions were straight out of the Chapter 7 BK Trustee handbook. I started a thread earlier on these, and it's at http://www.bkforum.com/showthread.php?t=39127&.

    There are more question that they can ask, but the first set of questions are 99.9% of the time the same. It's the alternate questions that differ between Trustees and a lot is based on what they saw in your petition.

            yeah its kinda nice to know how simple the questions really ARE, i kept having nightmarish thoughts of the trustee asking me things like how did i think i was going to be able to pay the debt in the 1st place and things like that, but the questions are very standard yes/no questions- very simple!
