CARES Act - 401K withdrawal and Chapter 13
My wife is in chapter 13 bankruptcy. Since she is the beneficiary on my 401K. I am aware that stimulus checks are exempt. I would like to know if 401K withdrawals under the CARES Act are also exempt from the bankruptcy. I am not part of the bankruptcy.Last edited by MikeG; 09-18-2020, 08:28 AM.

DONE! - My crazy 13 month BK journey! (LONG POST - but worth it)
Howdy! It has been a while since I have checked into the BKForum, which seems odd since I was literally on this site all the time from November 2009 - September 2010. I almost messed up 401 MONEY.
I wanted to share my dumb dumb mistake in case anyone was thinking of doing the same. I needed to take out money out of my retirement money, to pay attorney,so right before i filed I took out 6000. I was thinking it is protected. Wrong, once you take it out before bkrptcy it is asset. Lucky for me,...

Anyone here know about 401 k stuff?
I wasn't sure where to put this thread so I thought someone here might know about these things.
I have a minimal 401k savings account from my former employer. I am now unemployed and the rule is supposedly that after 6 months of being unemployed I can roll the 401k over into a new account,...
