My sister has a Power of Attorney for my brother and he wants her to file BK to stop a foreclosure on his house. Does anyone know if this is possible? He is out of the country and cannot be here anytime soon.

Few questions:
what is the reason your brother is out of the country? Military? If so, there are laws that protect him from foreclosure while in the Military.
Does the POA specifically state you have bankruptcy filing rights / financial decision right?
What reason has he / you not paid the mortgage? If you have financial rights, what reason will you give for not paying his bills?
Was the POA recorded in the courts? Done up by a lawyer? Is it a limited POA? Durable POA?

If so and there is a court date, than I would think the sister may have an easier time getting a continuance on the foreclosure suit, the brother can file himself when he gets back.If I knew it all, would I be here?? Hang in there = Retained attorney 8-06, Filed 12-28-07, Discharge 8-13-08, Finally CLOSED 11-3-09, 3-31-10 AP Dismissed, Informed by incompetent lawyer of CLOSED status, October 14, 2010.
