This just goes to prove that banks and merchants do not care.
In sept 2010 I went to kmart (for the last time) and bought some merchandise.
So just to skip this and that..I logged into my bank to see a duplicate charge
from kmart, so i filed a dispute with TDBank.com and indicated this must have
been a mistake (double charge) as I have seen this before in the past.
On 12/22/2010 I get the dispute letter from TDBank.com
We have completed our investigation into your visa check card merchant dispute
filed on September 24 2010 in the amount of $53.71. Our investigation has indicated
that an error did not occur and your account will not be credited. wtf?
The merchant in question (Kmart) has denied our chargeback request.They have responded
with evidence that an error did not occur. You will need to contact the merchant directly
for further consideration.

Kmart is saying that the merchandise was bought, then 9 min later
the merchandise was bought again, as they are saying the pin
number was entered, so therefore that must be the reason for the double charge.
I was with my wife when he bought merchandise from kmart, and I know this because
we do not shop at kmart often (I wonder why) and I was the one that found the double
charge when I looked at bank records online.
I was not with my wife at the register, so I can not claim to have seen her buy merchandise
9 min apart, but I did see the merchandise when she got out to the car. There was no double
merchandise, everything in her shopping bag was unique items, no double items, so unless
my wife rebought everything 9 min after the first purchase, then what happened to the merchandise?
If had committed fraud, I would not be posting this, nor would I be up in the
face of kmart and TDBank and when I have time, I will be in their god-damn face.
I see two things.
Kmart is committing fraud with their customers, or
kmart has screwed up and made a mistake in their investigation.
Because at this point, it really sounds like to me that kmart is telling
me that I have committed fraud by purchasing duplicate merchandise
9 min apart, then filing a dispute on one of the transactions.
I was also in kmart at some point, and kmart has few cashiers, and
there was long lines also. I wonder how kmart is going to explain how
my wife would have went back to the end of the line and back to the
cash register in just 9 min? This was not a short line either, and if
she did have double merchandise and was at the register, then why would
it have taken 9 min to ring up another $50 in merchandise?
KMART: You have some explaining to do!
TDBank.com - This is the second time you have screwed me on a legit dispute.
I think our business relationship is coming to an end. You are not protecting my interests.
