    employer provided housing and its termination/salary question

    State: Kansas

    Situation : I currently live in housing provided by an employer. We do not have a written lease, or even a verbal agreement as to termination requirements. I have not given notice to employer that I am quitting. (In the 9 months I have been employed here, I have seen 9 employees come and go, 4 by termination & 5 by quitting. Every one of them were told to leave the same day they gave notice without pay. Employer only has 3 fulltime people at any given time.) I plan to work through Dec 24 then quit. I paid a $300 deposit plus a $150 electric deposit & $100 "nonrefundable" pet deposit.

    Question 1: Since I am not giving 2 weeks notice, will I be entitled to my $300 deposit back (if house is left in same condition as when I moved in) or are they able to keep it?

    Question 2: I am a salaried employee paid on the 1st & 15th of the month. I have 2 days of paid vacation remaining & would like to use them. Can they refuse to allow me to use those days or refuse to pay them?

    Question 3: I would like to give notice Saturday (12/17) that I plan on not working after the 26th but will not be vacating the house until the 1st. Do they have to pay me through the remaining part of the pay period or only through the 25th?

        That's great you have a new job!

        Since you know in every case a person was told not to return the next day when they gave notice, you could take 2 vacation days on the last 2 work days before your new job starts and then give them 2 weeks notice immediately after you receive your paycheck.

        They'll tell you not to return and then you can start your new job.

        Of course if they really want you to stay for 2 more weeks, you'll be forced to decline.

        You'll have to plan on not receiving your deposit back, and then if you do it will be a nice surprise.
