The Myth of the Rule of Law

I found this article on the web by a Georgetown professor and thought it was pretty interesting, especially as most of us have had unpleasant contact with the legal system by being in debt.
It points out that law is an extension of politics, the difference between "law" and "order", how the state connects the two concepts in the (naive) public mind, and goes on to advocate more of a free market in legal services rather than the state-centric model. A good read for a rainy day.

filed chapter 13..confirmed...converted to chapter 7...DISCHARGED!

    yes...a good read indeed cat....

so many are under the misconception that law is justice and justice is law...there usually is nothing fair about the law.

I never broke the law. I am the law.

That article goes to the heart of the state prosecutor and the politics associated with the office. It's disgusting that politics has to play a role in the legal system, since Lady Justice is supposedly blind.

Well yes lady justice is 'supposed' to be blind, but it be blind folded and opened through the dirty politics involved in it. Nice read indeed! a different perspective of looking at things.

Very good read. Totally concur. Law is about judgements and judgements are made by people with built-in biases. Clearly it is best to people to have elected officials that have the same biases as they do, so long as they slight and reasonable.
