    You may be correct.
BK 7 filed and discharged in 2004 after 30+ years of perfect credit. Life HAPPENS.

Aloha to all. This is my first post. I read a few postings since joining the forum and decided to a search on "Dave Ramsey" to see what members thought of his program and his advise.

I've been listening to him a few months now and thought I could do the extra jobs, selling what I could, eating beans and rice, and living like no one else so that later I can live like no one else. But in early March of this year I realized I just was over my head with debt, the job market is very bad at the moment, and beans and rice is expensive (like everything else) where I live. I've decided that BK is the route to take as there is no way I can make even the minimum on all my debts ($42000 in CC and unsecured debt). I love to hear the warm and fuzzy "I'm debt free" stories on his radio program. But with a 10% cut in pay coming this summer, BK is the only way I can finally find some breathing room and lessen the stress the mounting debt I've accumulated. I'm hoping the a Chapter 7 will be in my future and before the year is out, I will finally ease the pain, stress, and burden my family and I have endured by filing for BK. I think Mr. Ramsey is a bit hypocritical about BK. I am disappointed that I need to file BK but this is the only way out at the moment and I am way over my head with debt and it would take years to pare down my debt by paying only the minimum payments and I don't have much assets. I still like to listen to DR but BK is looking better and gives my much more hope in a brighter future.

While I do agree with a lot that has been said here~
I have to tell you that we are at month 39 of 60 in our C-13 ... it's been very hard, and there are times when I think we WON'T make it.
We are in a 100% payback... paying our mortgage AND a car loan outside the BK...
We thankfully have a wonderful Trustee who has so far been sympathetic when we fall somewhat behind, but we are able to catch up.
We COULD have cheated, my husband could have quit his second job before we filed, and we could have gotten out a lot cheaper~ HOWEVER~
I do feel really GOOD about our choice to go thru this honestly and pay back ALL the debt...and I know in a few more months when it is ALL over with, I can do the "happy finger dance" to ANY and ALL creditors and NEVER borrow and pay another freakin dime to any of them AGAIN!!!!
But I assure you~ I know people who have cheated and got thru with a 7 instead of a 13... and they still to this day SUFFER because they haven't learned a thing...
Me paying this back~ trust me~ I've learned a hard leasson, and if anyone wants to judge me for paying it ALL back! Screw 'em!!
It just feels good to know that I will have paid back every dime...and even more because we should have done the 13 sooner... we would already be out of it, but I sleep better and better every month!

I would have quit the second job and filed a 7. 5 years I couldn't do it. It's not cheating, it's using the system. Cheating would be quitting both jobs. To tell you the truth I sleep fine and I haven't even officially filed yet.

tbon, nc73 didn't use the phrase "beat the system"... it was "using the system" and there is a big difference in that!

I beat the system and I was debt free the day I filed. 2.5 years later I have 1 year living expenses in the bank, No debt other than a car payment which I am doubling down on every month and my retirement is growing rapidly.

And I almost forgot--Life is good!!!

If I had filed for 13...I would be paying down debt--I wouldn't be going to NYC staying in a 4 star hotel next week...I wouldn't have gone to Turks and Caicos and stayed at Beaches resort last January and I wouldn't have just come home from Lowes where I spent $200 on Bird feeders, Outdoor chairs, grass, fertilizer etc (unfortunately it just started raining so I'm not working in the yard).

It's all about beating the system---duh!!!!!

I filed a chapter 7. Do I feel bad? Yes, but life happens.

If you want to suffer through, that is your choice. Doesn't mean that someone who quit a second job to qualify for a 7 is cheating. Or is wrong for wanting to have a life outside of work.

Just means that they are out from under a mountain of debt a whole lot sooner than you are.

Out of curiosity, if the Chapter 13 had only called for a 3% payback, would you have insisted on paying 100%?

                        Logan,
Good for you!!! I hope to be able to be in your shoes real soon! I kept my end of the deal up by paying my credit cards on time EVERY month and THEY decided to raise my interest rates up so much it was impossible for me to make even the minimum payments. Their reasoning was the market has dictated that they do so. Do I feel bad that I have to file? Only to the point that I have to "prove" to the courts why I cannot pay my debts no longer. I certainly don't feel bad that I may walk away from an enormous amount of debt. Screw Dave Ramsey and anyone who thinks he really cares about anyone but himself!!! Yes, I have an attitude. I'm glad folks like Logan can get on with life.. a GOOD life at that!!!

Dave Ramsey is a snake oil salesman, just like the scumbags on TV who advertise "Get out of debt" programs. He's very polished, and that gives him an edge with the particular guilt-ridden type of person he tries to appeal to. He gives some good advice, but you have to know what to take and what to leave. Unfortunately he's planted a seed in my family member's minds that BK is a terrible decision, so I'm struggling to even be able to talk to them about it.

Never feel bad about your BK. When it comes to money it's all business. CC's will raise your rates no matter the hardship so why should anyone feel guilty about shedding debt?

Everyone can turn it around like I did. I am no different than anyone here.

I've had discussions with people about BK and it's comical what people say and think. If Dave Ramsey looked at what BK did for me he could NEVER say I made a bad financial decision.
