    Can they do that?

    I filed Chap 13 back in April 2005. Included was my Bealls account, only $139.00 (I should have just paid it.) I recently checked my credit score and discovered that Bealls listed me as filing Bankruptcy in August 2009. This will be on my credit until 2016. I tried the online dispute through Experian but that came back as being verified. How can this be? Is this legal? Is there another way to get this taken care of? Thanks for taken time to read this.

    Did you send your discharge papers to the agency as proof?

      What do you mean by "discharge" papers. I have a few more months of payments to make for the Chapt 13. I assumed that the credit reporting agency (Experian) could see that I filed in 2005 and just correct it. It seems like a no brainer to me. Its crazy that the account that had the smallest amount of dept is now causing me the most problems.

        It seems to me that if you actually filed in 2005 and Bealls is saying you filed in 2009 and you have proof, that you should be able to send the proof to the CRA and they should delete the entry. If they are saying it is verified and Bealls won't budge, then you have grounds to sue them for violation of the FCRA. You would need to check with your local small claims court to see if they will let you file that kind of suit there. My local small claims court does not accept suits against creditors and CRAs for violations of the FCRA.

        This is also a violation of the automatic stay and you can look into filing, as justbroke just told me in another thread... Motion for Entry of Order to Show Cause and for Sanctions... for contempt of court in the bankruptcy court.
