    Somebody please tell me

    Is there any one here who has knowledge about Child Support.. (California)

    Situation: 25k arrears, 25k Balance total of 50k
    Income 600-700 Dollars net income Monthly
    Child Support payment 150 a month
    700
    - 150

    550

    Tell me How can i live with that?
    550 left over how can i pay rent, utilities , food. and clothing once in a while.
    I don't drive and no car and just walk to work.
    ask ride from here and there sometimes.

    Now.. I first establish my credit card never use it.. 300 available credit
    Child is over 18. never seen the child, too far another state. dunno where they live also. gf pop up one day preggy and claimed it was mine , cant afford DNA so i did the blood test ., result 90 percent matches my blood. So ok i guess..
    I want them to send me a paper why owe what i owed
    and statement of my balance now along with the payment history coz they never send anything.
    I want to rent an apartment, be able to drive to work, pay utilities and then whatver is left they are welcome to take it all.
    any idea?

    i know next to nothing about child support, but i thought child support ends when the child is 18. or maybe it continues if the child is a full time student. are they saying you owe back child support? or current child support?

    anyway, child support won't get discharged in bk so you are stuck with whatever it is.

      Yeah you can't file on child support. In order to get it stopped, you can have this child emancipated but that cost money for an attorney.

      It appears your income is way to love, can you find another p/t job? You probably should have gotten the support lowered long ago.

        Go talk to the lawyer. I'd say that paying the first bill would be near to accepting that the child really is your child. Get the DNA test if you doubt it. She could be going after anyone she can find who had relations with her. The first person to accept the child is his, is the payer. This is not legal advice. I'm not a lawyer.

          You probably need a lawyer.

          First off if you're 25k in arrears you've not paid child support in years if its 150 per month, possibly for the entire life of the child with an outstanding balance of 50k.

          You can't discharge child support in bankruptcy.

          You could with legal help perhaps negotiate a lesser payout since obviously your income could not pay the ordered child support. The question is when did your income drop so much and why you didn't seek modification then. Like I said you probably need a lawyer.

            Thank YOU PEOPLE

            First I don't intend to run away with my obligation.
            The only problem i have right now is To modify the payment and it doesnt matter if i have to be stuck with it forever
            i just want to be able to live now if i happen to get a better paying job they are welcome to take it.

            Now my question is is there anyone here who knows about child support?
            My main concern is I DONT WANT TO ATTEND ANY HEARING OR GOING TO THE COURT FOR THIS.
            I want to just write them a letter provide papers they need in order and be granted to my APPLICATION regarding modification.

            ANy IDEA..
            IF no.. its fine I appreciate u all.

            And yes I do need a lawyer probably but i cant afford it . thats why i figured asking people advice and studying will help me do this.

              I knew someone who was in a similar situation. He was denied the rights to see his kids and had to pay the state minimum even though he wages were also minimum. He managed to stay current on his child support only by renting a room in a home with another couple. He had no car or anything but his two jobs, one full time and one part time trying to survive.
              He denial to see the kids was illegal, but the judge that set the child support and set the restraining order was the uncle of the wife that that involved and the county sheriff was also her relative. All true. Sometimes you just can't fight city hall.
              He moved to Australia buy the way. It was the only way he could live.
              When the first child turned 18 a couple of years ago she got into contact with her father and she too is now in Australia and has no desire to return to Mom.
              Life is not always fair. Sometimes you just have to roll with the punches. Good luck.

                unbelievable!! that judge should have been automatically recused. every state has a statute that says that, not to mention code of judicial conduct in every state. and it's obvious.

                glad the child provided some justice when turning 18. when justice doesn't come from the court system, then you have to find it somewhere else i guess.

                  The judge is dead now, and the sheriff if no longer in office either. What goes around comes around.
                  But these rural communities get away with murder on a regular basis.
                  It's also my understanding in talking to him via email that it now appears that his second child will join him also when she turns 18.
                  The Mother is this case is a real lunatic, to say the least. They were married 14 years and all she ever did was insist that he made more money because she never worked a lick and spent money like it was water. He was living in a small town with all her relatives so he was stuck.
                  He could not control her so he divorced her and tried to get custody of the kids who were 13 and 15 at the time. They even told the court that they did not want to live with the mother.
                  If you have not lived in one small rural communities are different.

                    I don't understand how you are paying all of your bills on $600-700 a month in the first place.

                    You've known about this child since the mother was pregnant with it and the blood test matches whether or not you believe in blood tests.

                    If the mother of your child was on welfare then you owe that money to the state. If she was not on welfare and did it all on her own, then you owe her.

                    Many mothers work two jobs to support their children. They do whatever they have to do to put food on the table and clothes on their back while providing shelter.

                    There is no way I could provide for just myself on $600-700 a month, let alone a child. I would have to work more jobs and I have done that in the past. Go to my professional job in the morning and then go clean homes or wait tables at night and on the weekends.

                    Sounds like you're just going to have to do what it takes to figure it out but you won't be getting out of that debt.

                      I'm sorry, but this post is insane. If it's only $150/mo then you've never paid any child support? Or made any effort to contact the child? My guess is that it cost the mother a lot more than $150 a month to raise that child. DNA testing is not as expensive as it used to be - if you have doubts, have that done first - it seems you would be eligible for legal aid to help you sort this out. If it is your child, for crying out loud get another job or six and pay up on that measly amount of child support.

                        From what I was told when I iniated my child support case...if the named father contests paternity then they will do the DNA testing. However, if it comes back that you are the father, you have to reimburse the county/state for the tests. I suppose things may have been different 18 years ago.

                        And don't get me started on deadbeats lol Would you all like to know how much I get in child support....drumroll please......$33 a month! Yes that's right I said A MONTH. And to top it off I didn't even get the full amounth this month. I got $24.75. Gee thanks you douchebag, you are really helping me out.
