Angelina, doesn't a "right to work" state mean that a person is not required to be a member of a union? See http://en.wikipedia.org/wiki/Right-to-work_law What you are talking about is "at will" employment, which describes most of America. If an employer hates your nose, s/he can fire you. But, the question then becomes whether that person was fired for reasons which are against the law, including a host of civil and employment rights, granted by statutes or otherwise. That's a matter of proof and the quality of the attorney you have.
The proof which you describe which is generated by a subpoena would certainly help this employer, but I think if I were this physician I would certainly sue. A friend of mine was fired recently because she "used inappropriate language." She works in a retail setting and the words she used were "damn it to hell." I know as her friend that she rarely uses foul language and she told me she was really upset. Her co-workers on a regular basis use language like mf, wtf, etc. on a regular basis. She went to an attorney who contacted her employer and that was enough for her to receive a settlement. She's 26 and I don't think some of those older dudes ever thought a young chick would ram it to them. And, thankfully, she has a new job in a better environment.
