As you all know most large cities have commuter lanes authorizing cars with two or more people inside to use them.
Is a baby securely seated in a car seat/baby carrier considered a person for commuter lane privilege purposes?

A child is a person. Otherwise, commuter laws would read two or more adults.

However, they read, two or more persons.

(And, since this is a full service bulletin board, I'll go one further. A child, unrestrained, and jumping around on the back seat... is also considered a passenger for purposes of the HOV restrictions. )

I'm sure it would because there are folks in those lanes taking small kids to school buckled up in seat belts during early morning rush hour also. Your state's motor vehicle dept. can easily answer that question for you. Your posting made me recall the person I believe in Oregon or Washington who got caught using a blow up doll as a person in the front seat so he could use those lanes each day - made national news.

Yes, kids do get out of those seats, but the driver has the ultimate responsibility.

It is ROUTINE around here to see someone with a small child unrestrained in the vehicle. Apparently the police do not do anything about it. I have been passed on the highway by a vehicle doing in excess of 70 mph before, with a small boy standing up in the back floorboard between the bucket seats. I have seen people driving with small babies on their laps here in town.
My kids have always been buckled in, even if we were just going from one parking lot to another directly across the street. And I have stopped and given a few swats when they got out of their seatbelts. Usually only happened once or twice before they got the picture.
