    TSU student jailed on bogus Wal-Mart forgery charge

    HOUSTON -- "A college student’s trip to Wal-Mart last month ended with her in handcuffs and a two-day stay in the Harris County jail.

    Nitra Gipson was charged with felony forgery after the Meyer Park Wal-Mart manager accused her of passing bogus money orders. Thing is, the money orders were legit and had been purchased at Wal-Mart to begin with.

    The cash-strapped college student had just sold her car to pay for her last two semesters at Texas Southern University, where she is studying criminal justice. She was paid with Wal-Mart money orders, which the giant retailer advertises as “good as cash.”

    In Gipson’s case, they were as good as time behind bars.

    “Humiliating is not the word for it,” said Gipson. “I was horrified. I think they singled me out because of the amount of money that it was and (thought) I was trying to get over on them.”

    No manner of effort by Gipson to show that the money orders were legit worked. The store manager insisted she be charged.

    The district attorney’s office saw it differently. Charges were dropped after the money orders were verified when Gipson provided the purchase receipts.

    But after spending 48 hours behind bars, the damage had already beeen done.

    “Wal-Mart should be held responsible and accountable for letting this child go to jail for two days. All because she was doing what any customer of Wal-Mart should do,” said community activist Quannel X.

    Gipson said Wal-Mart then added insult to injury when she got a letter in the mail.

    “I started to read it and thought, ‘Oh my God.’ They are asking me to pay them when it was clearly their mistake,” said Gipson.

    The letter demanded Gipson pay Wal-Mart $200 to settle a shoplifting charge. It is a charge that never existed, though.

    When 11 News contacted Wal-Mart officials they said they were looking into the case and would provide no further details.

    The spokesperson did claim that the decision to pursue charges was up to the law enforcement officials on the scene. But the copy of the criminal complaint obtained by 11 News, shows that the store manager is who pressed charges."

    Now, for those that don't know, this arrest will be reported. She is already in in NCIC (National Crime Information Center-run by the FBI, available to law enforcement and private agencies) and places like ChoicePoint. In the new Amerika, an arrest (guilty or not, charges dropped or not) can keep one from getting a job.

    I had to stop at Walmart yesterday a.m. for a birthday card as I was in a pinch to get it out in the mail that day from work. Got the card, three bags of various mints for work and a bottle of Diet Coke (red cap bottle). Not only did the girl look like I was doing her a disfavor when I approached her register (her light was on for service) but she rang up the card twice and charged a 5 cent deposit on a non deposit bottle of sode that clearly says "please recycle, no refill." I caught the card being charged twice before signing - easily seen but she didn't catch it but didn't see the deposit. Watch what you are charged there because the checkout clerks are either over friendly if they are being watched or have the I don't care attitude if the supervisor is not around. No matter what your job, and it involves public contact, be happy you do have some source of income as any job is scarce in this economy. I really really nice with her about the whole thing from start to finish and she uttered maybe two works through the entire conversation.

    I am aware of the receipt check on the way out. Everyone pays for those who shoplift in one way or another and getting treated like one yourself.

      Bankruptpinoy: That girl has been handed a silver hammer. She needs a good Trial lawyer and can take Wal*mart to the bank. Her time and humiliation and false arrest could make her wealthy. I hope she signed nothing for Wal*mart and gets to a lawyer fast. If it was on the news, the tape can be subpoenaed.

      Wal*mart started to go under after Sam Walton died. I met him once at a grand opening as I was their cash register man. He believed in fairness to employees. He hated Kmart and that he promised a Wa*mart on every corner there was a Kmart. He about put Kmart out of business. He sold only American if available. Now they sell only China as what do we make anymore? When Sam died that is when the stores became less friendly and mega in size. We go there only if we have to as they are so huge and convoluted. If you want cleaning stuff, soap is here, a mop is two blocks down and one block left. I do like their zero tolerance on shoplifters. They will give you anything you buy back in refund for any reason. You have to admit that. But they will spend 5k to prosecute a 50 cent shoplifted item. ‘Hub

        I say she absolutely should sue them. I wish I had!!!! I tripped over a cord in one of their stores about 15 years ago and really messed up my hip, knee and back. They did pay for about $1,000 in doctor bills, which was all I asked for - but the woman I had to deal with was MEAN! She was very intimidating and just acted like I was at fault, etc. I am sure it was all part of the tactic. The pain and problems seemed to go away after a few months, but guess what - now I have all kinds of knee, hip and back problems and its too late.... sigh... I could have been so rich!

          My neighbor (local criminal Attorney) was just talking about how Walmart costs the taxpayers a fortune in that they want every single person who writes a check that bounces. (this happens at times and CAN be just a simple mistake) prosecuted to the fullest . They were at the point were they were refusing to accept payment after the fact in cash but wanted every single one even the ones for amounts under $10 sent to a prewarrant hearing to be forwared onto county court for prosecution.

          The County has had to cease some of this and now will only allow Walmart to file a complaint if the check was over $100 and attempts to collect are not fruitful. Anything under $100 is Walmarts responsibility. They can hire their own attorney and hire their own investigators and they are responsible for a fee impossed by the county for court costs.
          Makes sense to me.
          Can you imagine the little old lady who lives on SSI. Writes a check in Walmart for a few dollars more than she has in her account because she made a slight mathmatical error. Common mistake. Who has not bounced a check in their lifetime and then made good on it because it was an HONEST mistake?
          Well this little old lady would find herself being summoned to court as a criminal. Never even given the opportunity to just return to Walmart and pay the amount she owed without any further issue.


          On another note. I do shop at Walmart for certain things.

            Kinda makes you wonder how such injustice can befall a totally innocent person. But, all the wondering in the world cannot undo what has already been done. Walmart should be held accountable for damages to this student's reputation all the way out to seven figures, and the most significant digit should be greater than one. Walmart can easily afford it.

            The routine complaints about shopping at Walmart are valid, but I have found many an incredible bargain there. I neither love nor hate the place.

                I don't shop at Wal Mart and would drive whatever miles to another store before I would shop there.

                I hope she sues them.

                  I'm with the others...don't shop there, never really have. The few times I've been in there I've never noticed any good prices.

                  I hope she sues them too!

                    I kinda like Wal-Mart, mostly cause I can get more food there for my buck than at the grocery stores around here. I do think like many industries they have some questionable policies, but it seems the actions in the OP was the result of one manager and not corporate policy.

                      I honestly try not to shop there. The reciept check is the main issue.

                          At our store there is no bad checks. You see, Walmart has enterprised an immediate check draw upon your checking account. You hand them a check, the printer/reader reads the MICR numbers on the check and the clerk puts the amount in and hands you your check back with Paid on the backside. Like a Debit Card, you get hit right away. 'Hub

                            I shop there and I guess me like some of you are as guilty as the scumbag ceo's that send jobs abroad to save a buck. I really don't like the walmart-chinese connection either but I have to stretch my dollar too and walmart helps like it or not.

                            If the story happened the way it was published then I hope she does sue them!

                              "Nitra Gipson has a similar story. She is a pre-law student who sold her car last month to raise tuition to attend Texas Southern University.

                              The buyer paid her with Wal-Mart money orders. But when she tried to cash them at the Wal-Mart branch on South Main Street, the manager said they were forgeries and called police.

                              "They placed me in handcuffs and escorted me out the front door of Wal-Mart and put me in police car said, 'You're going to jail today,'" Gipson said.

                              She spent three days in jail and lost her job. The charges were later dropped when it was discovered the money orders were genuine.

                              "Here's a black person with money, suspect. And they need to stop that 'cause both these cases were cases in which the banks themselves had easy access to check the facts," Kelley said."
