    O Me O My! That's my District and I receive SSD. I just fired off an email to our BK Attorney as we will be filing on 9/30/09 using Mar-Aug. Income.
    If I don't have to include my SSD as Income to determine disposable income, all of my spreadsheets and documentations are fruitless!

    Jeezel Pete! Oh Oh, I hope Eastern Arkansas Trustees takes this Court Ruling into their BK Cases!

      Hope it helps you and some other members as well. FLORDIAN came to mind when I saw the case.

        Thanks! My Attorney files all his BKs' on the last working day of the month (small town). So I don't expect to hear from him until after the 1st of Aug., but that's Okay. We've been waiting a year to file, so waiting a week or two won't bother me much LOL!

        I sent Floridian a PM about this News.

          they are not fruitless; changing them will be surprisingly easy, and all in your favor. this is obviously great news.

          i wonder if the same holds for unemployment benefits?

            I agree Unemployment benefits shouldn't be included in Income as they are ONLY temporary benefits. Yes, I know you can renew them, but I think it's only for so many weeks.

            The problem is finding an Attorney who is willing to work for Free to fight for those of us who are darn right poor or we wouldn't be filing BK. It made me mad I had to hire an Attorney to fight for my SSD. He wrote a 2 sentence document, signed it & mailed it to SSD and I still got denied.

            I took it upon myself to write to my Senators & Congressman (small state), to help me win. This was after i had 2 of my doctors, one being a Neurosurgeon and the SSD doctor stated I was 100% disabled. I fought hard and even called my State Director. My Attorney received over $7,400 of my Back Pay and I had to pay taxes on what he received.

            If I had found this forum before we had retained our Attorney, we wouldn't have paid him $1,300 and I would have filed Pro Se. And then on top of that you have to pay for those stupid classes. Yes, the 1st one we've taken twice because our Attorney thought some addt'l monthly monies I was receiving was not included in Income. It Is! Dropped off in Feb. due to the stock market tanking. It was my 401K I had to spread out while I was fighting for disability as we were rear ended and I made good money as an Accountant before the accident.

            Sorry for the Rant.

                thanks for the info... i have been tardy from this forum for a while...
                i just fired off an email to my lawyer about this court decision and asked if it will help me here in florida.

                i doubt i will be that lucky, but it sure would solve my problems..

                  got an email back from my lawyer... he didnt seem to flinch at the link i sent him... he said once again, that i pass the means test and have a problem with disposable income.. damn! it sounds like he would like me to file and get out of his hair..
