I filed my chapter 13 a week early to avoid my audi from being repoed. My attorney and I called Audi to let them know that I filed. I know that audi will have to petition to relief of automatic stay in order to pick up the car. My 341 meeting is Nov. 23, and my comfirmation meeting is not till April. When will audi more than likely petition to relief the automatic stay?

They likely won't you just have to include the car in your plan. They would only do that if you were behind on payment when filing a chapter 7 or they had repossessed the vehicle before you filed . I wouldn't worry about them filing for relief. -
I am surrendering the car, I didn't include it in the plan. I don't think the trustee or judge would agree paying back 2% and having a car payment of alomost $800.Comment
