lawsuit from fender bender prior to bk

I had a minor fender bender prior to my filing for bk. bk has been discharged. My attorney... I mean my ins. company's attorney says that they may try and find grounds to make me responsable for the claim and not cover me. Since the accident happened before my bk do I have anything to worry about?
The accident was a minor fender bender at 5mph, the other cars passenger is claiming injuries and offered to settle for 40k. I was not cited at the scene for anything.

Did you answer yes when the trustee asked if anyone could sue you? If you reported this then you should be ok, especially if you were not criminally negligent, but it would be worth a consult with an attorney.
