    Redemption

    I got a letter from my SUV finance company that was a notice of intent to sell. The letter stated I could redeam the vehicle for the balance owed plust fees etc. This is a good deal for me so I got a made arrangements and mailed a cashiers check. The SUV was surrendered in BK 7 which I am discharged and closed. Anything I should worry about?

    If it was discharged on May 18th, and you did this without a Redemption hearing, they are WRONG WRONG WRONG. For a redemption you only pay the current wholesale value. I think that you may have been "had".

    You need to consult an attorney.

      well, except that the current wholesale value, if that is the blue book, is like 7k, and I only had to pay 2900. I hope I don't get into any trouble over it.

        Well, you shouldn't get in trouble, but they should be ashamed of themselves. Anyhow, if it's worth more than $2,900 then I'm not so mad.

          thanks justbroke. I acted impulsivly and problably could have settled it for less, but to tell the truth I am just happy that I got it back. I financed it in 2005 for 27k, all told paid about 38k with interest, so I will loose no matter what. But at least I have it now and can sell it for a little extra. Funny thing is that GMAC is the finance company and they never filed a reliefe from stay. I indicated intention to surrender it on my petition, they called me about a month after I filed and asked what I was doing with the vehicle and I told them surrender. They made arrangements to pick it up and I thought that was the end of it. Is that the norm?
