    Repo man looking for me - help!!

    I am in the process of preparing everything for a pro se filing either today or monday and just received a voice mail from the finance company that they have a repo man looking for me.

    I have recently moved and they do not have my current address.

    My question is will the automatic stay still apply even if they have already hired someone to repossess the car?

    But what is the end game scenario for the car? If you are not going to keep it anyway, why prolong the inevitable.

      Because I need the car, and this will give me time to come up with the money to purchase a cheap car for cash.

          Yes. They do. I am planning on missing work until I get this filed. Which should only be two days. My job does not care because we are really slow, which is the problem because my pay has been cut in half during the last year.

            My question to you is this is. Where did you move to is it in the same city or state? Do you work for the same employer. Is your vehicle registered to your old address or new address? Have you applied for any credit at the new address? If you haven't did any of these things Then you don't have much to worry about. I did see you mention that they called you on your phone. Is it a cell phone or a land line phone and if it is a landline phone is it published or nonpublished. If it is land line phone that is non published then it is much harder for them to track down the address. Not saying it can't be did but it will take some time. I can't say if they did any of that just yet but if I were you I wouldn't worry too much and what chapter are you filing chapter 7 or chapter 13? If you are filing chapter 13 once you tell them you filed most will return the car to you if were it repossessed already. I don't think you should worry too much. Especially if you moved And didn't leave a trail if you did well they have to be able to put the trail together unless you gave them all your new information.

              So they know where you work. But the other questions still applies is the car still registered to the old address or your new address. Did you apply for any credit at the new address where they would be able to pull your credit report and see the most recent addresses. If not I would not worry too much. If I were you I would ask a friend or relative that is not listed on my reference list to keep the car at their house until I could get my paper work filed. To be safe you shouldn't park the car where you live or at any of the references houses over the weekend. Hey stay at a friends or close relative this weekend.

                Thanks for the advice. I haven't applied for any credit, but I did put in a change of address with the post office about a week ago. I have no home phone, just cell phone and they don't even have my new address yet. The only people that I have given my new address is the post office. I am a little worried about that now.

                  Don't worry

                  I called the Post Office and they said they don't notify them of your change of address. The only thing they do is forward you the mail.

                      I thought you could request address service from the Post Office that provides you with the forwarding address. In the course of having my creditor matrix served, I used "address service" request, and mail was returned to me with yellow stickers indicating the new forwarding address.

                        True enough. If you have "Address Correction Requested" on the envelope the forwarded address will be provided to the sender for a fee with the original mailing continuing on to its destination unless it is a "Do Not Forward" and then it may just be returned with forwarding info applied at no extra cost IIRC. Not sure as I have been out of the loop when it comes to processing mail for quite some time.

                          Also keep in mind, the day you file and get the automatic stay, the creditor can put in a relief of stay and you will have appx 15 days to answer or get an automatic judgement. You are giving yourself maybe 3 more weeks with the car possibly. Chase bank did that with us.
