Can a repo person open your unlocked garage door to take vehicle?
I would think that would be breaking and entering, but have read conflicting
opinions.

Legally they are not supposed to "open" a garage in most states (I do not know about NY law). Problem is, it becomes a "He said", "She said" and will likely not go anywhere anyhow.

By law, no they can't. But if they have the vehicle and you have no "proof" you are really out of luck. Anyway why bother if you are behind on payments and can't afford the vehicle. I kept my vehicle in my garage for months before I filed chapter 7 and reafirmed. I guess I was just lucky they did'nt follow me to the grocery store, they could have gotten it there.
