We have not filed a ch 13 , but may have no choice soon.
My question about repos:
We have a car that we are just over a month late on with a local credit Union (would have been less than a month, but we made a mistake in our checking account and the check bounced
. This was for the later part of Nov payment). As soon as I saw that the checked bounced, I called the CU and left a voicemail with person we had spoken with a week ago - and apologized for the stupid mistake and asked if they could send the check through again. Yesterday I recieved a call from the collection dept and this person did not know about my voicemail. I explained, but she said I would need to pay with cash because they would not resubmit.
So, I said I would come in the next day (today) and pay cash for the NOv payment, and would just exchange the cash for the check (tear it up). She said she would transfer the check into our savings acct with them?? Unfortunately, we won't have enough in our checking acct to clear that check AND pay in cash (double payment......which yes I know we also owe for end of Dec payment, which we said we could pay on the 15th).
I still plan on going into the CU and paying the cash today but I am nervous. Any suggestions??
