    Question concerning Current Apartment Rental not in my name

    I have been going back and forth for 6 months concerning allowing SOL to expire at 4 years (Next Spring) on my debt or to file Bankruptcy.
    Currently Im researching back into the Ch 7 route.

    I currently am in a very lucky sitution due to the love and trust of my girlfriend.
    Due to my credit situation (Nearly 40k in unsecured credit card debt 3 years overdue and sold to creditors) there would be NO easy way for me to get into a rental. She put her name on the lease and pays the bills each month, I am listed as a tenant. She does not live there.

    Could filing cause me to get evicted somehow?

    I doubt it but wanted to ask for other opinions.

    If the rent is paid on time every month, I don't see why they would evict you?

      Does she have a lease? Remember, she would be evicted (as the responsible party) and you are a "tenant". As stated, they rent for money. Unless you become a problem, why would they toss a customer? 'Hub

        As a landlord, I'm going to disagree with the two posts above. What your girlfriend did is application fraud, and from a landlord's perspective a MAJOR red flag. This is why: what you did is also what drug dealers do... lease a house under a different name, then cook meth, deal, etc. until caught and evicted. Or worse... a mother rents an apartment so her pedophile son can live there.

        Landlords are not respected very well, and get the blame for the drugs and criminal behavior in their properties. The news media doesn't talk about how the original applicant lied... only that the landlord (or "slumlord" in their eyes) "put" a criminal into a good neighborhood.

        I'm currently going through this situation now: a tenant has moved in another person and both of them are dodging me. It is obvious to me that the second resident doesn't want to go through my background check, which tells me there is a reason he would not pass. I'm serving them with their termination papers later today. It's a shame becuase the first tenant has been good... but hits house is 500 feet from an elementary school.

        Your girlfriend needs to go to the landlord ASAP and request to have you added as an authorised resident. If your state allows, offer to pay a higher deposit.

          As noted before I AM on the lease as a resident.
          I have meet with the apartment complex management several times with no problems including renewing the lease in the same sitution.
          I have been in the apartment for 20 months now.

          The second part of my question I initally forgot to include is showiung I use part of my income to pay the rent via transfer to my GF's checking account.
          Therfore showing where my money is being spent.
          That was my major concern I guess more so.. by showing I have an apartment with her na,e if it would somehow bring her into this mess.
          Which is the last thing I want..thus why there is no ring on the finger yet.

            My apologies, I completely missed that in the original post. I blame lack of coffee at 8:30... if your girlfriend is the leasee and you are just an authorized resident, I'm not sure what the BK would do.

            Did you give the apt. management your SSN and DOB?

              Possible. I dont remeber honestly.
              But when looking over my credit reports yesterday I did see an inquiry from "Tenant Track" around the same time we started the lease.

              So I guess thats more than likely a yes.
