    File Petition WITHOUT the schedules?

    The petitions provide a place to list the case number. To me, that implies that I can file the petition now, get a case number and THEN file the schedules. Is that true?

    If so, how long do I have to get the schedules filed?

    "At a minimum, you must have the Voluntary Petition, Exhibit D to the voluntary petition, the Mailing Matrix typed list of creditor names and addresses, and the Verification of Mailing Matrix (local form)." Then, in the Appendix to the local rules, you find this:
    "Missing Documents:
    If not included, a master mailing matrix must
    be filed within 2 days. Any other missing
    documents are due within 14 days from date
    of filing or the case may be dismissed."
    That was taken from the Western Missouri district website.

    *when filing pro se, it is very helpful to go to your district's website and find the local rules and read through them....at least it was to me ;)

      Yes, you can file what is known as an emergency petition. But you only have 15 days to file the rest.

      However, the emergency petition is not just the Form B1. You will need to check the local rules for your bankruptcy court (go to your bankruptcy court website), but an emergency petition typically requires Form B1 (the petition), Creditors Mailing Matrix, Consumer Credit Counseling Certificate and Form B21, Statement of Social Security Number. Since you have to do the creditor mailing matrix anyway, you should usually do the various creditor schedules (D, E, & F)

      I guess the bigger issue is (1) why wait. The form's, themselves, are not that difficult to complete, (2) what has happened such that you need a case number in a hurry.

        When I filed, I did file an "emergency petition". I didn't understand it to actually be an "emergency petition", and that was neither my necessity or my intention. I just appreciated the extra few days to dot i's and cross t's on the rest of the forms before they were "due"....and you know... stress myself out just that much more. It worked out, but I could have stressed over the whole package at the same time in the same amount of time and submitted it all together. If you are going to go this route, pay strict attention to your deadlines.

          I filed a skeleton petition, but mine was only missing the Chapter 13 Plan, which I promptly filed within the allotted time (it was 15 days back in 2008, now it's 14 days). I would never suggest to anyone, to file a skeleton (emergency) partition unless they really know what they are doing, and have the dedication to complete the filing. Unless you're being foreclosed upon tomorrow, take the time and complete all the schedules!
