    Questions for application for waiver of CH 7 filing fee.

    I posted this in the General Forum but after two days I have a lot of views and no replies so maybe I went to the wrong crowd and will have better luck here. I'd like to file within the month so I would really appreciate your responses.

    Since I am currently living with my parents(paying no rent or utilities), I am a bit concerned about 3 questions on form B 3B, Application for Waiver of Filing Fee. I have listed the questions and my explanations and I am looking for guidance and suggestions on whether or not I am answering these correctly in such a way as to remain honest but not get myself into trouble. Please let me know if you see something I do not, and offer any suggestions you may have as far as wording or something that may raise red flags.

    4. Monthly income - $703(average)

    5. Do You expect the amount in Question 4 to increase or decrease by more than 10% during the next 6 months? Yes or No.


    Explanation: As an independent contractor, income often fluctuates due to inconsistency in available work. Currently experiencing ~25% decrease in monthly income. Actively looking to increase income by way of acquiring additional work or obtaining new employment.

    6. Monthly expenses - $684

    7. Do you expect the amount in Question 6 to increase or decrease by more than 10% during the next 6 months? Yes or No.

    Explanation: Pending increase in income, I am expected to contribute up to additional ~$425/mo for rent and utilities. Pending significant increase in income I expect further increases in monthly expenses to include payments on past due 2009 and 2010 income taxes, health insurance, auto tires and eventually renting own apartment.

    18. Please provide any other information that helps to explain why you are unable to pay the filing fee in installments.

    Explanation: Due to currently experiencing a decrease of ~25% in monthly income, it has made it increasingly difficult to afford even minimum monthly living expenses.

    Hi AL,

    I am a pro se filer too. When I filed for the fee waiver, I did not fill out anything on the B3 form; the court used my Schedule I form. If you are filing pro se you will need to go to court(the court will send you the time and date to come in) and the judge will determine if you(household income) fall under the 150% income guideline for your household. I was denied and placed on an installment plan because my household for a family of 5 exceeded the income guideline by $500. I hope that helps. Good luck to you.

      Just filed today. I did mine a bit different. I downloaded the fee waiver form online. And filled it out myself. Also I'm not sure if everyone that files a waiver has to come in for a court date, I do believe that is at the judge's discretion pending your case particulars. I've heard some people just receiving a letter in the mail a week or so after filing saying whether they are eligible for the waiver or not. I think the answers to your questions are good. Be truthful, don't paint a rosey picture if isn't one. GL

        I received my letter saying my fee waiver was granted about a week after, along with a copy of my letter to creditors. I actually already had my 341 hearing the other day.

        So I will say if you get called in for a hearing on the waiver, IMHO it's because you're probably not getting it waived. And if you're in full right to have it waived you should just get the letter with the judges signature like I did.
