    dmv fines.

    I'm filing chapter 7, I have 600$ worth of dmv fines to pay to get my license back. I know these fines are not dischargeble, with that being said do I have to wait for my case to be closed before I can pay them back. I have someone who is willing to sell me their car by making monthly payments till paid in full, when can I start doing that? I've searched every where and can not find the right answer.

    You didn't indicate when you're filing. I would not purchase the car until after filing. The reason being, that if the person who sells you the car doesn't do the paperwork correctly, and it's within 90 days of filing, things could get complicated! If it were me, I would probably wait until after filing to pay the fines. Where are you getting this money to pay the fines? Are you sure this money is exempt?

    Because you are filing pro se, you need to be cautious with transferring or obtaining assets... including money. You don't need to wait until your case is closed, but you certainly need to be very very aware of the fact that if the car isn't sold the right way (with a lien enforced through the title)... things could go very bad.

      I'm filing within the next two weeks. I'm getting the money from my income, right now Im begin garnished. I know that it stops when I file so that will be extra money coming in.


      That's how he was going to sell me the car, with a lien on the title. ...

      So I should wait till after filing or when I'm completely discharge? As of right now I don't have a car and depending on other people is taking a toll on me... :/

        I'd wait until after you file.

        As far as the garnishment, it's not going to stop immediately. The company with the garnishment has to tell your payroll company to stop the garnishment, which by law they are required to do, it's just a matter of how long it takes them. I'm going through this right now, I'm about 6 weeks post filing and my pay is still being garnished by the state of Maryland, though I did speak to an Attorney from the state this week who informed me they will stop the garnishment and refund me the money for the past 6 weeks.

          Thanks for your help.


          I was told to fax my case number to payroll and it would stop next pay period. I was also told that I would get the garnished money back too but that would take a few weeks... that's good news for you!
