no asset chapter 7 exemption question/s - Illinois

Hi, last Thursday (3/17/11) I filed an emergency Pro Se no asset chapter 7 BK in central Illinois.

To me my case seems quite simple. I still have a few questions though.

First, I have very little in the way of assets and plan to use standard exemptions ("wildcard"?). Do I still need to fill out a form listing all material on-hand assets? I fall well within the means test, and all of my assets as well fall well within the standard exemptions allowed.

Second, I owe the IRS tax money for my return to work in '09. I listed the IRS in my creditor matrix. Is there another form/schedule I should file to deal with the tax return filed for tax year 2009?

Next. My girlfriend wants to loan me money to purchase a good used vehicle once this is finalized. Is that okay, or must I list the "intention" to borrow funds for a vehicle upon discharge of my BK? We're not talking extravagant here mind you, just a good, older, used vehicle.

My 341 meeting is slated for April 21. I can't express the sense of relief I have felt since filing. I was left bewildered (honestly), wondering why on earth I waited so long to do this. I guess we really do grow too soon old, too late smart.

I can say, though, that finding this forum, reading, joining, the helps here, has been monumentally helpful.

    Cheers from Illinois!

I hope that you used and/or have a guidebook to help you file. You still have to exempt your assets, regardless of how minor or insignificant they are. You then, on Schedule C, list the appropriate statute that allows you to claim the exemption -- and in what amount you claim the exemption.

I hardly every would recommend an emergency filing pro se, but since you have already filed, you need to hunker down and get the rest of the paperwork completed. It needs to be extremely accurate (since you chose to do a skeletal filing) and well done, so as not to cause you grief in front of the Chapter 7 Trustee.

Your IRS taxes are not dischargeable, but still need to be listed as Priority Unsecured Debt on Schedule E.

Best wishes, and keep asking questions.
