    Last question regarding date of documents ...before I file tomorrow..

    Hello...hope someone can respond....

    1. I dated my documents December 24, 2010 although I will not be going to file til tomorrow 12-29-10.. is this acceptable?

    Am completely stressed and drained over this process...thanks everyone that responded to my questions....Can't wait to catch up on much needed rest.

    I don't think the date you signed the papers will make a difference, but to be sure, I'd call the clerk in the morning and pose the question to them. The important date that will be noted is the filing date on the petition. In our case, the bk courts are 3 and 5 hours away, so we mailed them in. Our signature dates were obviously different than the filing date. No problem.
    Filed pro se, made it through the 341, discharged, Closed!!!

      Thanks free2breathe for your response. ... agree don't think the actual signing date needs to be filed date...will bring additional copy that I did not sign;just in case....

          Hi torosnca,

          I did the very same thing with my documents and didn't have any difficulty. I dated all of mine on December 20th, but wasn't able to get to the courthouse until the 23rd. But like free2breathe said, it would be a good idea to call and make sure just in case.

            Hi there.. so Toro you filed all your stuff by yourself ? May I ask where you got the forms ? Im in Florida and the ones on the courts website are hard to follow and some dont apply to us. Thank you. Congrats and good luck

              torosnca....I signed all of my paperwork on December 21st and hand-delivered the documents on the 22nd, and it all went smoothly. I was pretty nervous since I was filing pro se, but I called the clerk and she said it was fine.

              swampchick...the clerks at the bankruptcy court are not allowed to give you legal advice, but they CAN help you when it comes to figuring out what forms you need to turn in. When I called the clerk, she gave me an entire list over the phone of which documents I needed to file, and how to create the creditor matrix. I live in Florida as well, and I can happily say that even though I only filed on Dec 22nd, they have already mailed a notice to all of my creditors and already the phone calls have stopped. My 341 meeting is scheduled for only a month away, so the whole process should only take about three months. It was HARD to do all the paperwork myself, but I pushed through it in about two stressful weeks. I wish you all the best and hope it goes smoothly for you!

                Hi swampchick...yes filed it by myself. As you're in Florida....google "Florida Bankruptcy"..then select the geographical area that you're in. The site should tell you specifically which forms you will need if doing a Chapter 7. I printed a copy to use as a worksheet then went back to the particular form, typed and printed. A working copy really helped me as I needed to edit and make constant changes to the info. Didn't want to make any mistakes if at all possible. Once I completed my forms took it to Fedex for make a copy for my records. Hopefully this helps...really have enjoyed this site...we're all here to assist each other if we can. I was unable to hire an attorney and had to rely on research and assistance from this site here. Good luck..
