    Filing in Kansas

    I began filing on July 23rd, pro se. My 341 meeting is August 30th. Just have a few simple questions. I need the entire history of my loans at a local payday loan company in town. Can I simply write them and request it, or do I have to also register that request with the court? I need this information and I'm sure they will use any and all information about me before or at the 341.
    Yea, I said it payday loans. more like The Downward Spiral Instantiated. Any helpfull info anyone has as to how to deal with payday loan lenders would be invaluable. I'm sure they will try to say they are excuded from my bankruptcy or maybe even scream fraud. But the truth is they have made thousands of dollars off of my in interest as I have been stuck in a chain with them going back years (on and off). Its simply time I put my foot down. I have heard the judge or trustee will usually take into consideration these daisy-chain type of loan situations. I certainly hope so because this is just the tip of the iceburg.
    Anyhew thanks for any helpfull advice.

    So yea, I'm just gonnna write and request my loan history. Certainly I am allowed to do this.

    Also, I found out that one of my creditors sent me to a new collection agency just yesterday. Seems like a violation of the stay to me, seeing its almost a month after the start of my filing. That is rediculus. Now will I have to amend my filing? Can't I have them penalized now for violation of stay?

      If the creditor received notice and you have proof of this (check BNC via PACER) then yes the creditor is violating the stay if the collection agency contacted you outside of the bankruptcy. The original creditor is responsible for the actions of any collection agent operating on its behalf. No you don't have to amend your schedule, but you can send a copy of the bankruptcy notification the collection agency. Not sure why you need the entire history of your pay day loans. Just wait and see if they file a claim. They either will, or will not, provide the proof there.
