    Exemption Question

    So our 341 meeting went okay but we have to change our exemptions page, as I used our new state and should have used the old. My question is do I have to exempt our vehicles since there is no equity in them?

    If there is no equity, you need not exempt them. However, I'd still list them on Schedule C for exempt property. The exemption amount would just be $0.00.

    There's a method to my madness and I learned this by being in Court one day. If for some reason, the title on the car is defective and the Trustee is able to someone avoid the lien, then you would lose the car and maybe any "exemption" you may have been able to claim. (Yes, you could amend later if the lien avoidance thing happened.)

      Well the title has our banks name on it lol so hopefully there'd be no way for the trustee to do that, but I guess you never know.

      Now on to the retirement account and figuring out which state we actually CAN claim exemptions in.

      We live in Iowa now, since early March and before that I lived in Oregon for 30 years and my hubby lived there for 12 so they said we can't use the Iowa exemptions but wouldn't say anymore. In addition the nice attorney that I saw regarding our lease won't look at them because he feels that he'd be obligated to look over everything and he isn't willing to do that. *sigh*

      This is the ONLY thing in our BK that has gone awry really so I can't complain *too* much since I saved 1200 bucks.

        Didn't you already go several rounds with this question in another thread? It's not that complicated, really. You simply haven't lived in Iowa long enough to claim the Iowa state exemptions.

          Tiger, yes there have been responses to a SIMILAR thread in another forum. However, does it hurt to post it both places? Maybe someone that doesn't go to the other one but comes here would have input and vice versa. Thanks your post was 100% completely unhelpful.

            Right, "unhelpful" because the EXACT same question was already answered in your other thread.



            Since I already knew that I couldn't conjure up a different answer for you, I chose not to spend my time trying to do so.

                Also, it is against forum rules to post the same question in different areas, or multiple times.

                For this very reason, it pisses off those that legitimately try to answer forum questions and pissed you off when you start getting snarky responses since you already posted the question and it was answered.

                  Now I read the forum rules and didn't see that anywhere, so sorry.

                  On that same note though, it seems that my ORIGINAL other post was about actually WHAT PAGE I needed to switch NOT about my vehicles which is what I posted here. So snarky comments are rude and probably uncalled for. It's not like I spam these forums. Only one person responded here and so I mentioned other things from the other post as well to them, but not to the "snarky" tiger. They didn't have to respond, nor did they have any helpful information.

                    "There is no need to agree with each other, or to even like each other. However, by signing onto BF you agree to treat each member and guest with the respect they deserve."

                    Do you believe that tiger has treated me with respect by making "snarky" comments instead of just keeping their mouth shut? Just curious.

                      You should have been treated with more respect. BK can be very confusing and stressful, especially for those of us who are new to all of this. Many of us come to this forum seeking help, advice & support.

                      It seem's to me that there is nothing wrong with asking questions trying to clear up some confusion, (in my opinion) with a situation.

                      It was a little upsetting for me to see your head bit off for posting a simple question.

                        Shall I post the content of your original post, which you obviously edited quickly but which did make to me in email, and then shall we talk about snarky?

                        Seems to me you also accused your trustee, who is not your friend, not your attorney and who cannot give you legal advice of also being rude and unhelpful, for not telling you the answer to your exemption question.

                        You'll find yourself pretty short of answers that way, but yes, I am happy to not respond to any more of your posts, per your request.

                          You can post whatever you like. However, even though my original post to you was snarky I quickly regretted it and realized that it wasn't called for no matter how rude you were so I changed it. That seems like a fairly reasonable, adult thing to do. Wouldn't you think??

                          The trustee WAS rude, several other people commented on it and the trustee in my area is KNOWN to be rude and that's the first thing that the lawyer told me when I first consulted with an attorney. It wasn't rude that she couldn't give me advice, it was rude HOW she said her other statements. Even my husband commented on it when we left and he is the nicest person you'd ever meet and he always thinks the best of people and rarely says ANYTHING bad about other people.

                          So, again, MORE snarky comments and no MOD to tell you that you're violating the rules on this board. No reason for it. You obviously don't like me or my posts so move on already.

                            Please relax everyone. New members facing or in bankruptcy are very timid and perhaps sensitive. We are all very fair and go out of our way on our own personal time with no compensation for doing so. As HHM, a moderator on this forum wrote, duplicate posts cause angst and frustration for not only the regular members, but can become frustrating for the original poster as well.

                            Let's not lose the message here.
