    Help!!

    Hi all just a couple of last minute questions before I turn in my FINAL amended documents.

    1. Do I list my student loan payments on schedule J and if not why not being they are apart of my expenses?

    2. On schedule D what would qualify an amount as "unsecured" or "encumbered" for my house and car?

    3. If I have a second car that is paid for, do I list that on schedule C as exempt?

    4. How accurate do the dates need to be on schedules that ask "date claim was incurred", some of my debt is really old and I cannot remember exact date?

    Wow, those questions don't sound very close to final to me.

    Unsecured is the amount of the loan outstanding that exceeds the valuation of the secured property.

    You can only list exemptions that are appropriate for your state. So I can't answer question 3 for you, because I don't know what your state exemption limits are and I don't know what your paid off car is worth.

    Dates should be as close to accurate as you can remember, month and year format.

    Sounds to me like you have quite a bit of stuff to figure out before you are close to final though.

      Well to be exact, I filed my petition on 6/11 and already have a case number. I used the Nolo book and just found this site yesterday and it made look back over my paperwork and these were the only things that I didn't feel 100% sure about and this isn't the easiest thing to do on your own and is very important to not mess up. So to make sure all my t's were crossed and i's are dotted I thought I would make sure I amend the pages I am unsure about before my 341 meeting to ensure not to interfere with my 60 days. But thanks anyway for your help.

        Look up your exemptions here: www.legalconsumer.com

        You probably have the most recent balance you owe on the secured property as of your filing date. As to value, check with your contact at the court as to what valuation they will allow you to use (NADA Retail or private party for example). Get a CMA for your house valuation (they are free).
