    Update: was i able to get a student loan while chapter 7 is pending?

    Hi all. I haven't been on a while. I've had my mind off the bankruptcy. I couldn't find the thread I started on this. To let those of you know, I promised to update if i was able to get my student loan. Find the other thread for more details (if needed) but it was a federal guaranteed loan and it was a stafford loan.

    the answer: I finally got my money, but not without trouble. i had to wait until disbursement date, it didn't go through. had to call bursar 3 days in a row, the hold would not let it disperes my account. got them to print a manual check so i could go cash it. Also every time i try to register, drop classes, or do anything with my college account - im having to go call them to lift the hold . it is right back on a few hours later as "FEDERAL-LOAN HOLD".

    fyi for those who didnt read the other post. my school had to call and find out if they could evendo it, then they had to take extra steps processing my loan which took a while. you cannot get private loans as far as i know. you canont be in default on student loans either. as long as your not in default and qualify for the federal need based loans (stafford) then your suppose to be able to get it. i called finaid.com 1800 number, my fin aid office, etc... to get to the bottom fo this. been a big process gettin my laon when it used to be automatic, but you should be able to get it, or at least i did.

    ABOUT PRE DISCHARGE COUNSELLING. I accidentally filed my cert. before the 341 meeting. the court clerk yelled at me, but its going to be okay they said. ill update on that too when its all over.

    Pre-discharge certificate only needs to have been done after filing and before discharge. There's no language in the Bankruptcy Code or the Bankruptcy Rules stating that it needs to be submitted after the 341 Meeting. The Code only requires that it's taken after filing.

    Even if your District has a local rule stating to file it after the 341 Meeting... it's a stupid rule.

        tigergem- thanks Im happy to update and give something back, since you guys have helped me so much. Im glad im done too, thanks Now if july 23 would just come around (last day for objections). I'm not anticipating any objections though.

        justbroke- i thought that was stupid too. especially, because i called the court clerk ahead of time to ask them. they said they couldn't tell me since it was "legal advice." but as soon as i let her know i had done it she didnt hesitate yelling at me with her "legal advice" saying " You were supposed to file it AFTER the 341 meeting." Then when she transferred me to the guy who is at the other end (I guess he closes the cases or follows up at the end) , and he said it would be fine.

          Sometimes, the clerk's office says some stupid things. I just had an incident with a "deficiency" because I didn't complete a particular form. However, I'm not required to file it because I'm a non-consumer case. It clearly says so on the form. I actually filed it, and checked "non-consumer". Oh well.

            just broke - wow isnt it sad they work there and they dont even know!!! they should be cautious of confusing the pro se'ers . its hard enough to do it all on your own.

              p.s. now im having trouble ordering my "final" transcript for grad school. The Federal-Loan hold is like a parasite that wont go away !!! My case should be discharged in around a month, so that better come off of there automatically! 'm not too sure on that one. ill keep that updated too

                UPDATE: last day for objections is July 28. Shortly after that i should be discharged. Ive been so preoccupied by some crazY neighbors whove been harassing me, i havent even had time to call the court to find out of there were any objections i will let u all know . I need to call soemtime this week.

                  I'm in a similar situation myself......would it be safe to assume that your suggestion would be for me to hold off on filing for bankruptcy at least until after the semester starts?

                    I have gone through the same situation now. It feels like you are going through hoops just to get the holds lifted. I have been approved for my loans and grants, but they are having to fill out extra paperwork now. I applied for my funding prior to filing Bk. It is always fun to have to do the adjustments after filing. The school even wanted a letter from my trustee stating I could have the loans. Thing is I am in a chapter 7 and the trustee has already completed his job. My lawyer had to submit a paper stating this, I had to submit a signed statement stating this same thing, and I also had to give them a copy of my pacer info.

                    If I could have held off I would have. It would have been a lot less stress, a lot less paperwork, and a lot less hassle. Every week I am having to run up to the school twice a week to give them something new. I will be going again this week to turn something else in. It just never ends.
