Just Had 341 Meeting!

    Hi my friends,

    It's obvious to me why the pro se filers go last. It's because the lawyers are billing time. A pro se person is not billing time. The lawyers will be pissed off to have to wait around that room for their case to be heard. [So they made it clear that they have to go first. I (myself as a pro se) perfectly understand it. I'm just interested to understand the whole process-- slightly bemused by it, philosphically speaking.) The lawyers who make their keep by this are not bemused by it. ] They want to get in and out fast as possible. They are billing hours.

    But what does interest me slightly, is that I did not have a real US Trustee. Somehow she was just filling in. She was not a real US Trustee, and announced as much at the beginning of the 1:30pm slot for which I was scheduled. How do they hire these people? What are their credentials?

    I don't understand how they hire these people and who they are.

      For point of emphasis, I think it is very important, who is the person we are meeting with; what is their credential; who are we dealing with?

      I think bk forum might alert us to who we are dealing with.

        I went second in my group. There were 3 lawyers waiting. I went second at my 341 Meeting because mine was a conversion and I only had 2 or 3 questions to answer. The rest of the time was joking around with the Trustee and his assistants.

          We still marvel at what questions other people were asked compared to us. Not quite sure whether to be happy or more depressed about the situation... But even more so, the fact that those WITH lawyers still had a lot of missing paperwork and info that the trustee worked them over for.

          Then he gets to us and "Well I see you have everything here", asks a few questions, and done.

          A followup question, if someone could answer. We are just making sure everything is proceeding as normal. We see on Pacer that he filed his report, and used this line:

          (Note: I am NOT including any numbers or personal information in this, if this is inappropriate please let me know)

          (Trustees name) having been appointed trustee of the estate of the above-named debtor(s), report that I have neither received any property nor paid any money on account of this estate; that I have made a diligent inquiry into the financial affairs of the debtor(s) and the location of the property belonging to the estate; and that there is no property available for distribution from the estate over and above that exempted by law. Pursuant to Fed R Bank P 5009, I hereby certify that the estate of the above-named debtor(s) has been fully administered. I request that I be discharged from any further duties as trustee.

          Does that mean what I think it means? That unless a creditor files an objection we are golden?
          Filed Ch. 7 Pro Se on May 7th, 2010
          341 on June 1st - no Issues!
          Discharged 8/6!

            As long as no creditor files an objection and the UST doesn't get involved you should be discharged 60 days after your 341.

              It means that you're a no-asset case and that the (panel) Trustee is done with your case! Now, you only need to wait out your 60 days.

              If the United States Trustee (UST) wasn't at your 341 Meeting and/or doesn't file any notice of presumed abuse within 10 days of your 341 meeting, you're pretty much on cruise control to your discharge!

                Let's compare notes.

                I did not pay for anything (except the bus); it's not because I'm cheap, just broke. And all should know that you can do it this way. Not that I recommend it.

                I did not pay for a lawyer.
                I did not pay for a filing person.
                I did not pay for $299 filing fee.
                I did not pay for the certificate of whatever.


                [But my Public Counsel person reminds me to be sure I get that second certificate of financial knowledgability. [I must be careful not to forget to do that. You too! She told me it would cost $260 if I forgot. She insisted that I do it right away.]

                It's too ironic. How can I afford to pay for these things? Why did I file bankruptcy in the first place?

                I did not go into this venture as a savvy tax accountant or corporation looking to win something; I went in as just broke. I actually could not afford any of these things.

                The system graciously will allow you to do this. I am impressed by our system of government that allowed me to do this. The only thing it required was a lot of time and intelligence and diligence. So it actually demanded a lot.

                [Each phase makes it seem like it is over. But you importantly point out, there's the potential of objections.]

                  Goldfish - Check out www.bknow.com - You can complete your pre-discharge education course online and it only costs about $40. Just make sure they're accepted in your district. (Check the UST web site.)

                    Thank you very much for your input.

                    I'm not sure whether I can get through this last thing free of charge. I will call the last company I used (Abacus?] They will tell me whether they have the service.

                      I paid $50.00 for the first course, but that amount was refunded to me after I filed. My trustee offered the second course for free on the day of my 341.
