Pacer showing "terminated" instead of "satisfied"?

    Pacer showing "terminated" instead of "satisfied"?

    Good morning all,

    As if my heart needed any more troubles, I logged onto pacer this morning to see how things are going, seeing as how our 341 is on the 1st of june.

    I log in and see... All the paperwork I turned in this week isn't showing "satisfied", it's showing "terminated"!

    I went through everything with the clerk, got complimented on how complete and correct everything was, and went down the checklist, everything was there and turned in.

    Is this something a clerk can answer? Why it shows "terminated" and not "satisfied"? I went through my copies (yes, I made 2 copies of everything as well as an original) and I can't see anything wrong.

    How they use the various Deadline/Hearing statuses are confusing. Some things are marked as terminated (to stop a timer, like the 11 USC 521 timer), and some things marked as satisfied. Some things are marked as both.

    For example, I have 3 Section 341 Meetings on my Deadline/Hearings page. One is marked terminated (that was my Chapter 13 341 Meeting). The other 2 are from Chapter 7 with one being marked "satisfied" and "terminated" (as they re-issued the 341 Meeting notice), and the 2nd one is only marked satisfied. Almost everything else is just "terminated".

    I don't think you need worry, because if there was an issue, there'd be a corresponding entry on the Docket (History/Documents) for a deficiency or other issue.

      /whew okay.

      I did check the docket history, there was one thing on wednesday (i had forgotten the statement of financial affairs, it showed satisfied but she noted it wasn't, thankfully the clerks are nice), but that was turned in yesterday and the record there reflects it.

      1 week and a few days to our 341... just getting nervous. lol even being prepared, it still twists the stomache a bit.

        I don't like that word either, but that is what mine says too... on a few different things. "Terminated". I didn't completely freak out the first time I saw it. I guess I sort of knew or deduced that was the court's warpy twisty way of saying "Ok". I mean the corresponding filings sort of spoke for themselves, anyway...

          Okay, not meaning to dredge this up again, but this is bugging me...

          So I got a 'defiency" notice in the mail again saturday, that was dated Friday (we are in the same town as the court, so often receive the stuff next-day).

          The item it said was 'deficient', I had turned in on Thursday, and confirmed then that I had turned everything in. heck, even on Pacer it says I turned it in. But now I get a "if you don't turn this in we could dismiss your case".

          At what point do I call them and ask what the problem is?

            What does the deficiency notice say? I think you should call them right away or go there and ask them. It would be good if you could ask the same person who told you it all looked good when you turned it in, in the first place.

              The deficiency notice is saying I am missing the statement of financial affairs, and that "all items are due within 14 days of filing, if you do not comply under statue xxxxxxxx your case may be dismissed".

              I will call to double check, because I have a copy of everything stamped by them...

                  sorry for the delay in responding, was called into the office for most the day. Fires to put out, etc etc

                  No Case manager that I know of

                  I stopped into the clerk's office, here is what happened:
                  The letter was set in the que on Wednesday, the day I was told I still only needed the statement of finances.

                  I turned the statement in on thursday in the AM. While I was in there filing it, the letter printed out in the que.

                  The letter was officially filed after I turned in the statement, but printed before i did. So I was told to ignore the deficiency statement.

                    The "Intake" clerk only takes in things. They don't "review" things for completeness or whether it's missing. They only spot check that it has "wet" signatures and is on the appropriate form (especially where local forms are involved)... that's it.

                    Once scanned, it goes to your Case Manager. EVERYONE has a case manager. Call the Clerk's office and ask who is assigned your case. This is the person who "really" handles the documents sent in and issues deficiencies and "clerk-initiated" orders.

                    Make friends with this person! Always be pleasant. Always proceed questions with "this is a procedural question". Don't get upset if you get the "that's a legal question".

                    Good luck. You still have problems with your package!
