No asset case, except for my truck that I owe 9,500. Which is about what it is worth. Hope i can keep the truck!

Checkmate21 I have not filed as of yet but have been planning to for over a year. I have retained counsel and have researched BK in MA extensively. Their is absoliutely no way you can proceed with a BK an to have not filed tax returns for the past 3 years. No if's and's or but's. It's just not possible. I don't know who gave you that advice but you may want to look elsewhere for advise. Sorry to rain on your parade.

I'm self employed and have been losing money over the past few years. I won't owe any money, so not a big concern. I just have to file.

Take it from someone else that is self employed get all your returns ready and your ducks in a row. Be prepared to file your returns right before you file BK. Retain an attorney especially if you are seld employed.

Yes, you certainly need to file your taxes. It's a Debtor Duty under 11 USC 521. The Feds want to know that you're in compliance with tax code at the time you file.
                              Chapter 7 (No Asset/Non-Consumer) Filed (Pro Se) 7/08 (converted from Chapter 13 - 2/10)
