    My 14 Days is up this Wed. MUST DO!

    Hi Guys,

    The Court told me I had a "Notice of Intent to Dismiss Case" because I had "failed to file" Sch. C, Sch E, Form 22A, Stmt of Fin Affairs, [all complete nonsense because I filed these but apparently on not up to the minute forms]
    And a notice of "deficiency" [for assistance of non-attorney...] local 1002-1(g).

    Here's a couple of questions so far.

    1. It's unclear to me whether I'm supposed to have to re-submit the entire case (ie copy everything again) or just the pages they ask for. [1 original; 1 copy; 1 copy for me of what they now ask for]


    2. In terms of timing, I filed Wed 4/21; this Wed. is 14 days from when I filed.
    I am extremely concerned about this threat of dismissal. Is my best course of action to get matters sorted out by tomorrow, Monday {or possibly Tuesday}; by which I mean, bring my papers to the Court House tomorrow, ask them to confirm that I have submitted what they need, so that if there remains a problem, I still have a day or so to deal with it? [I'm still trying to deal with the old tax issue (have an appt Tues with tax people), but don't want a dismissal on account of going there late then having wrong forms or some such.

    3. Should I bother with those Public Counsel People before going to the Courthouse? They have hours Mon and Wed from 10-2.

    I'll be needing to write in now for very fast response because I'm under the wire.

    I think you should re-fill out the forms they asked for, on the correct, up to the minute forms off their website and don't wait until the last minute on this, because the court doesn't mess around. You don't want all your hard work and your future financial situation to be in a big mess because of a little thing like this. If you have a few hours to kill, I would suggest taking advantage of the court advisors, just to make sure you have everything and there won't be any surprises. Best of luck.

      I'm a little confused about the notice of deficiency regarding the assistance of non-attorney. Seems to me that you should be filing this as your own attorney/no attorney. How did they even know about the Public Counsel involvement?

      I guess if anything, I would want to go talk to Public Counsel about that, but since they steered you wrong in the first place with the forms, I think you should be cautious of their advice.

      Other than that, yes, just fill out the forms they say are missing.

        golightly, you make much sense. Yes, this is nonsense.
        My form says (12/07) and their current form says (4/10). So right now I will rewrite all those codes.... I should think one could just photo them onto to the newer form. I'll start now rewriting stuff.

        And thanks Tiger.

        Can I change anything I previously wrote? Meaning, e.g., can I change Schedule E now to list tax debt.

        Though they did not ask me to amend Sch. B, if I withdrew $500 from some checking because I knew I needed to close it, do I have to worry about this stuff.

          Yes you can make any changes that you need to, to those schedules that they said are deficient.

          As to the bank account, since it was open on the date you filed, that is still the date you filed, so no, I would not amend that bit.

            do I need a notary republic ?

            I'm filling in the local form of "Stmt Regarding Assistance of Non-attorney Local Rule 1002 -1
            Here's the question: do I need a notary public?

            "I declare under penalty of perjury...."'

            I can't imagine that I have to have a notary public sign this.
