    Just filed, now what?

    Forgive me, I'm sure this has been asked before. I've tried googling this site for this specific question but can't seem to find it.

    I filed last week, the clerk said I turned in everything necessary and I got my notice of filing in the mail. Now what? I've been following the NOLO Ch. 7 book by repeat trips to Barnes and Noble downtown. Now, their only copy is gone.

    1) Do I need to mail anything to the creditors myself? I remember reading something about having a relative mail notices to the creditors, but I can't remember if that applied to me.

    2) Carmax sold my account to a different collection agency the same day that I filed. I got a call from them Monday and she said something along the lines of, "You filed? Okay, we'll give it 30 days for the disposition to arrive." Do I need to add this collection agency to the creditor matrix and resubmit?

    Unfortunately I don't have the money to buy the book, so I was just reading it and taking notes on how to fill out the schedules. Now that the book is gone, I don't know what the next step is. I checked other stores but they don't carry it in stock. They will order it for me, which doesn't help since I can't buy it until after I finish paying the filing installments.

    My 341 is 4/15 so I appreciate any and all responses.

    You should check your local bankruptcy rules and your local rules of civil procedure to find out if you need to have a third party do any mailing for you. I didn't have to do that, I just mailed stuff myself and submitted a certificate of mailing to the court each time I had to. But different districts have different rules. Since this is a procedural question, you can also call your bankruptcy clerk and ask if you are required to have a third party mail notices for you.

    Personally, I wouldn't worry about adding the collection agency on to the matrix until you receive something from them in writing. And you should wait anyway. Because chances are they will send in their own request to receive notices to the court, and save you the $26.00 fee for adding a creditor. The important thing is you have the underlying debt in your schedules. It is not your responsibility to keep track of how many times it changes hands.

    Also, once a creditor requests to receive notices, you only have to provide notices GOING FORWARD. You do not have to back track and make sure that they receive every notice that was sent prior to their request. I hope that helps. Good luck!

      I found another book across town and found the section in question. It was regarding the statement of intention. I didn't have anything to put on that form so I don't have to mail anything else.

      As for the second part...thank you. I'm not planning to amend anything now.

        I just went to NoLo Press and see that they jacked up the price of the eBook version! Wow... business must be booming over there. Otherwise, i would have had you go to that site and get the book for $7 or so using the "416" coupon code. Looks like they stopped!
