    Got my Meeting of Creditors date-Questions please

    Hello everyone.

    It's finally warmed up here in Georgia. No more 22 degree weather right now...sunny and 64 degrees!



    May I please ask a few questions for clarification?

    **I received the B9A No Asset Case form and it lists the name and address of my trustee.

    So, do I need to mail him a copy of my tax returns and my B8 Chapter 7 individual debtor's statement of intention form along with a letter like this:

    Re: YOUR NAME YOUR CASE NUMBER



    CERTIFICATE OF SERVICE

    The undersigned certifies that a Debtors Statement of Intention has
    been served upon Panel Trustee, TRUSTEE NAME AND ADDRESS GOES HERE;
    THE CREDITOR NAME AND ADDRESS GOES HERE; and to the Clerk, US
    Bankruptcy Court , ADDRESS GOES HERE
    On this ___ day of ____, 2010, by regular, postage pre-paid, U.S. Mail.

    Debtor

    _________________________________

    ?

    **And I plan on taking the Hummingbird's Financial Education course for purposes of a bankruptcy case after having filed at:



    and then mail that certificate to the trustee.

    So, for clarification purposes, am I supposed to mail the statement of intentions, the notice of service, tax returns, and the financial education certificate to the trustee?

    Hi Xue: Congrats on the warmer weather!

    To answer your questions: Yes. Take your course, get your certificate and send copies of it, and everything else asked for, by certified mail with return receipt, to the trustee.

      Pleased to see you got your 341 date. I have to admit, I don't know what that form is that you mentioned. Is it a GA form?

      About your weather, 22 is like summer, we had 17 here in FL near Palatka.

      The educational school has to be your local approved school so I could not say much on that. We got a folder from our lawyer and we took the course online out of Tampa. It was a great course of about two hours and we did reap good info. Take it as what it is, and enjoy it. You can't flunk it. They will send your certificate to you and your lawyer.

          Sorry I'm not as fast as the Cats! In any event, you are in good hands. Congratulations on getting filed and good luck on your upcoming 341 Meeting.

          So, for clarification purposes, am I supposed to mail the statement of intentions, the notice of service, tax returns, and the financial education certificate to the trustee?
          You need to "serve" the Statement of Intentions (SofI) on the Trustee as well as any creditor mentioned in the SofI. You would then file a Certificate of Service not too dissimilar to the sample you poted above. This certificate and the SofI is then "filed" with the bankruptcy Court. For your tax return(s), you only need send them to the Trustee (no certificate of service required). Most creditors don't ask for them, and you would only send them to a creditor if they ask or subpoena them.

          As for the financial certificate, you do need to file an Official Form 23 (B23 - DEBTOR’S CERTIFICATION OF COMPLETION OF INSTRUCTIONAL COURSE CONCERNING PERSONAL FINANCIAL MANAGEMENT) along with a copy of the actual certificate. I know this from experience, as I submitted only the certificate, and promptly received a deficiency notice regarding Form 23. This certificate, and the certification, is filed with the Court, not the Trustee (unless there's some strange local rule).
